Do I need a solicitor when I’m buying a home?
Yes, is the simple answer. This is probably the biggest purchase you will ever make, so you need to make sure your legal rights and responsibilities are clear.
You’ll need a solicitor to ensure a smooth process, to ensure your interests are protected and to make sure that the sale isn’t held up due to issues that could have been avoided.
We will receive and advise you on contract documents from your seller’s solicitors as well as carrying out searches with the land registry and local authority (and obtain further planning documentation if required).
Your conveyancing solicitor will advise you on all documents and information received and provide you with a full report of the risks, responsibilities and rights that go with the property. This will also include advising you on the conditions of the offer made by your mortgage lender.
Once the terms of the purchase are agreed, we send you a final contract for signature. Following the exchange of contracts we arrange for all monies needed to be received from your lender and you – but you will need to arrange your move yourself.
At this point we can complete the purchase for you and you will then own the property.
After completion, we will deal with payment of Stamp Duty Land Tax and registration of your purchase at Land Registry.
It’s important to note that your solicitor does not dictate the timescale for completion, the main factors are the wishes of the other party to the transaction, lenders and builders, and most of all other linked transactions.
