Since October 2007 this Offence carries 6 Penalty Points so how can you avoid being convicted of it?

It is sometimes known as

  • failure to provide information
  • failure to nominate a Driver
  • failure to furnish information

Section 172 of the 1988 Road Traffic Act requires the Police to issue a Notice of Intended Prosecution (“NIP”) to the Registered Keeper of the vehicle involved in the commission of certain Offences within 14 days of the Offence being committed. In certain circumstances, including where such notice is given verbally by a Police Officer to the driver of a vehicle, this does not have to be given in writing.

A written Notice does not have to be received within 14 days but it must have been issued within 14 days of the alleged Offence.

The Registered Keeper then has to provide within a reasonable time (this may be specified in the NIP) details in writing of who was driving the vehicle at the time.
